Terms of Service

You must be able to enter into a binding contract to use the Service. You're responsible for the accuracy of information you provide and for activity under your account.

• Don't use the Service to violate any law or third-party right.
• Don't attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.
• Don't upload content you don't have the right to back up.

SafePod Backup is a digital service. Upon successful payment, access is delivered immediately in the form of account activation and feature access. By purchasing, you expressly acknowledge that the Service is provided instantly and that delivery has occurred at the moment of successful payment.

Instant delivery: Access is delivered immediately after successful payment.

No refunds: All sales are final and non-refundable once access is provided. By completing a purchase, you waive any right to a refund except where a refund is required by applicable law. Where the law of your country (for example, EU/EEA consumer protection law) gives consumers a statutory right of withdrawal for digital services, that right may be lost as soon as performance of the service has begun with your prior consent — by purchasing, you give that consent and acknowledge that performance begins immediately upon payment.

You may cancel future renewals at any time from your account. Cancellation stops future charges; previously paid periods are not refunded.

• Billing cycle: Monthly subscription in EUR, charged at the start of each billing period. Annual billing available on request.
• Payment methods: Visa, Mastercard, American Express, SEPA Direct Debit, and iDEAL (EU), processed by Stripe, Inc.
• Failed payments: If a charge fails, we may retry and notify you. Continued failure may result in suspension of the Service.
• Renewals: Subscriptions renew automatically until canceled. You authorize us to charge your payment method for each renewal.
• Chargebacks: Filing a chargeback for a properly delivered subscription may result in immediate suspension and recovery of the disputed amount, plus any associated fees.
• Taxes: Prices may exclude applicable taxes, which will be added where required.

You retain ownership of the data you back up using the Service. You grant us only the limited rights needed to operate, store, and restore your backups on your behalf. See our Privacy Policy for more information.

We work hard to keep the Service running, but it may be temporarily unavailable for maintenance or for reasons outside our control. We target a 99.9% monthly uptime as a best-effort objective for all plans. A contractual SLA with service credits is available on Pro and Custom plans; terms are set out in the relevant order form.

You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms, fail to pay, or pose a risk to the Service or other users.

The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free.

To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of laws rules. The exclusive venue for any dispute is the state and federal courts located in Johnson County, Wyoming, USA, and you and KACHKOUCH EDGE LLC consent to the personal jurisdiction of those courts. The parties will first attempt to resolve any dispute informally by contacting admin@safepodbackup.combefore initiating formal proceedings. Nothing in this section limits any non-waivable consumer rights you may have under the mandatory law of your country of residence.

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.
